Terms of Service

These terms govern your use of the Hunter Works Software website and online store (the “Site”). By using the Site you agree to them. Use of the Binocular software itself is governed by the End User License Agreement, and our handling of personal information by the Privacy Policy.
1. Who we are
Hunter Works Software is an independent software business operating in Australia. You can reach us at hello@hunterworks.software.
2. Use of the Site
You agree to use the Site lawfully: no attempting to gain unauthorized access, no interfering with its operation, and no scraping it for spam or resale. Content on the Site (text, screenshots, branding) is ours and may not be republished commercially without permission.
3. Purchases
- Prices are shown in US dollars. Any applicable taxes are calculated and shown at checkout.
- Payment is processed by Stripe; we never see or store your card details.
- Licenses are delivered electronically, by email, normally within minutes of payment. If your key hasn’t arrived within an hour, check spam and then contact us — we will always resend it.
- Business, Site, and Enterprise licenses can also be purchased by invoice or purchase order via sales@hunterworks.software.
4. Refunds and consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Beyond those rights: because a fully-featured free trial is available before purchase, we ask that you evaluate the software before buying. If something has gone wrong with your purchase — a duplicate charge, a key that won’t activate, an edition bought in error — email us and we will fix it, refunding where appropriate.
5. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to that, we are not liable for indirect or consequential loss arising from use of the Site, and our total liability in connection with a purchase is limited to the amount you paid.
6. Third-party services
Checkout is operated by Stripe and subject to Stripe’s own terms. Links to external sites are provided for convenience; we are not responsible for their content.
7. Changes
We may update these terms from time to time; the current version is always at this address with its “last updated” date. Changes apply from posting and do not affect purchases already made.
8. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of that state have non-exclusive jurisdiction.
